Delay to the implementation of the Building Safety Levy Bill until after the Scottish Parliamentary Elections to allow changes to be introduced


Announcement at Holyrood 18 November from Ivor McKee, the Minister for Public Finance

  • The Industry has raised significant concerns around the lack of clarity on levy introduction and the lead-in time.
  • The commencement date for the levy will be deferred by one year until April 2028
  • The Scottish Government will set out indicative rates in June 2026, after the Scottish Parliament election has passed
  • The levy will apply to all relevant completion certificates accepted on or before 1st of April  2028,

What Happened to the buildings in the original Single Building Assessment Pilot Scheme?

 

Pilot review

The 107 buildings on the Pilot were put on a pathway to assessment, starting with pre assessment checks made by an appointed fire engineer consultant.

51 were assessed as being out of scope of the Housing (Cladding Remediation) (Scotland) Act, following a review by the appointed fire engineering consultants.  

Of the 56 buildings within scope:

  • 10 of the buildings have been taken on by the developer
  • two were identified by the fire engineers as being low risk and not requiring an SBA
  • 12 have had or are undergoing an SBA commissioned by Scottish Government  
  • 32 will require an SBA – these will now have the opportunity to be funded for assessment through the Single Open Call

Updates November 5

 Lots of information today


Update on buildings which were in the initial pilot scheme where a Single Building Assessment (SBA) had been undertaken and there was a developer identified who has been advised by the Scottish Government of that assessment and which it is envisaged shall take the process forward to a new SBA, and deal with remediation work.

You will recall that where the buildings did not have a developer, or they were without the financial resource to undertake the next steps then those 'orphan' buildings, the Scottish Government is taking the process forward.


However there were 10 developments -where a developer is identified to take the process forward.
There are 6 in Edinburgh and 4 in Glasgow, with 4 developers identified.

CLADDING UPDATE 24 APRIL 2025

  1.  Developer Remediation Contract

    The Scottish provisions include a legally enforceable contract between the Scottish Government and the developers which are responsible for giving instructions to suitably qualified professionals to undertake the components of a Single Building Assessment 

    • Fire Risk Assessment of External Walls 
      and 
    • Fire Risk Assessment of Internal Areas

and then for the specifications for remedial work or mitigation, and the work necessary to implement that work to enable the building to be entered on satisfactory completion. on the  Cladding Assurance Register. This contract  has been under negotiation for a long time, but it is understood the terms are now agreed.  It is envisaged that each builder will sign a contract, the terms of which will be the same for all developers. The process is now identifying with those developers the properties for which they are responsible, and with regard to which they will be legally liable. Once defined, the contract for each developer will need agreement by the developer's board. It is estimated that maybe 150-200 buildings . 

  The aim is to have this finalised and in place by the Parliamentary recess which commences on 28 June.


2. RICS  published a list of individauls who had completed training to enable them to undertake EWS assessments.

  • The list was published  on 4 April  and may be found here :-

        3 .The Scottish Goverenment's Single Open Call for Expressions of Interest  to identify                     buildings which may need assessment has produced 31 responses to date.

With the expansion of the Scottish Government's scheme to include Registered Social Landlords  ( RSLs) and Local Councils, it is not a surprise that it is estimated that more than  50% of responses are from tenants or RSLs
         

       4. The 'spend' on remediation will clearly be spread over the period of time each builidng                 takes to complete any works.

Final Meeting of the Ministerial working group on the Scottish Government Response to the Grenfell Inquiry Phase 2 report was held today

Please help

This questionnaire has been previously issued, but the number of responses was disappointing 😞

It would really help us, and those in government (national and local),  and service providers (e.g. Scottish Fire and Rescue Services, NHS Scotland, Safer Scotland) to understand  how aware owners and residents are of the procedures and plans in their particular developments to prepare for emergencies in them.

You are strongly encouraged to participate. It really could, just be life saving! 

The answers that were received indicated a huge amount of ignorance as to these plans.

As owners and residents we have the opportunity (maybe 'responsibility'?) to let those in authority know the extent of the problem, and contribute to a safer home environment.


If you have previously responded there is no need to respond again!
